TERMS & CONDITIONS

The following general terms and conditions of contract are the only terms governing the purchase of goods and services via remote sale on the website available at www.marandospareparts.com (hereinafter, the "Website"), whether items are standard catalogue products or customized upon specific client requests, where available.

The sale of catalogue goods and services is strictly B2B and reserved for professional operators (i.e., businesses and/or professionals with a VAT number — hereinafter referred to as the "Customer"). Private consumers without a VAT number are not permitted to make purchases through the Website.

These general terms and conditions prevail over any differing contractual conditions adopted by the Customer, which Marando Service S.r.l. (VAT no. 11431230017), headquartered in Via Legnano 27, 10128 Torino (hereinafter also referred to as "Marando"), does not accept, even if not expressly rejected. These terms are deemed accepted upon submission of a purchase order and shall apply to all future contractual relationships between Marando and the Customer, even if not explicitly referenced again.
 

1. ORDERS

By submitting a purchase proposal, the Customer offers to buy a product or service listed in the catalogue (the "Product" or "Products"). For non-catalogue Products, the Customer may submit a request via email specifying the desired features. Sending a purchase proposal does not bind Marando — unless otherwise indicated on the Website — nor does the online offer constitute a public offer pursuant to Art. 1336 of the Italian Civil Code. Only upon explicit acceptance via email from Marando will the distance contract be considered concluded.

Before submitting an order, Customers must carefully read and understand all instructions and these General Terms, as they become binding once Marando accepts the proposal. The Customer must complete and send the electronic order form, place the Product in the “cart”, review and accept the General Terms and Privacy Policy, choose a payment method, and proceed.

Errors in data entry can be corrected by following the Website's dedicated procedures before submitting the proposal. Customers may adjust the quantity of Products or remove them from the cart before finalizing the order.

Product availability is updated in real time; Marando cannot guarantee the allocation of any Product. By submitting the order proposal, the Customer acknowledges that, if accepted, it implies an obligation to pay and full acceptance of these Terms.

If Marando's order confirmation contains differences from the Customer's request and these are not disputed in writing within 8 days, the confirmation will be deemed accepted. Upon contract conclusion, Marando will issue the invoice, which will be sent along with the Product and will serve as the sole warranty document.

If the order is accepted, Marando will send confirmation to the email address used during registration. The order and confirmation are deemed received when the intended recipient can access them.

2. CONTRACT FULFILLMENT

Unless otherwise agreed or specified by Marando regarding execution or delivery times, the contract will be fulfilled within 30 days from the date of order confirmation.

Delivery is deemed complete when the Products are handed over to the carrier selected by the Customer from those listed on the Website. If Marando fails to deliver on time, the Customer must grant an appropriate extension before cancelling the contract.

Products will be shipped only through Marando's contracted carriers. Upon delivery, the Customer must check that:

  1. The package is intact and undamaged.

  2. The number of packages matches the invoice.

Any complaints must be made immediately to the carrier. If the package is visibly damaged, the Customer must:

  1. Accept it with reservation ("Accepted with reservation" written before signing), or

  2. Refuse it if damage is evident.

In the event of non-fulfilment due to unavailability of the Product, Marando will inform the Customer and either: a) provide a substitute of equal value and quality (with Customer’s explicit consent), or b) refund any amounts already paid.

For shipments outside Italy (if available), customs duties and fees will be borne by the Customer. Marando is not responsible for such charges. The Customer must verify these costs in advance. If the Customer refuses to pay customs fees or to receive the delivery, any costs (including return to Italy) will be charged to the Customer. Customs procedures may cause delays in the delivery of the Product.

3. PAYMENT METHODS AND PRICES

Accepted payment methods:

  • Visa and Mastercard credit cards

  • PayPal™

  • Bank transfer (in advance)

  • Cash on delivery (contrassegno)

Charges will occur upon order confirmation. The cardholder must be the same person placing the order. Marando reserves the right to request ID verification.

Card data is managed exclusively by PayPal and encrypted using 128-bit SSL. Marando cannot access these details.

Marando may verify cardholder authenticity with the issuing bank, which may take up to 5 business days. Only after positive verification will the order be processed.

Prices are listed in Euro and do not include VAT. Shipping costs are calculated at checkout before payment.

4. WARRANTY AND RETURNS

Standard warranty lasts 12 months unless otherwise stated (e.g., used items).

If a Product under warranty is defective, return shipping costs for replacement will be covered by Marando. The Customer is responsible for any additional delivery costs (as displayed on the Website).

Returned items must be in their original packaging. Failure to notify defects within 8 days, or upon discovery in case of hidden defects, will void the warranty (Art. 1495, Italian Civil Code).

The Customer may withdraw from the contract within 7 days of receiving the Products by writing to marandoservice@gmail.com, including:

  • Order number

  • Reason for return

  • Photos of the Product

Returns will be refused if:

  • The Product is damaged or incomplete

  • It is not in its original packaging

Marando will provide return instructions within 7 days. Return shipping is at the Customer’s expense, and 25% of the purchase price will be withheld as return handling fees.

Refunds will be issued within 7 days if:

  • The Product is returned undamaged and unused

  • It does not belong to the “Sold as seen” category

  • Return instructions were strictly followed

Unauthorized shipping methods may lead to refusal or loss liability.

5. GOVERNING LAW AND JURISDICTION

The sale contract, including transactions with foreign businesses or deliveries outside Italy, is governed by Italian law. The Court of Turin shall have exclusive jurisdiction over any disputes relating to the execution, interpretation, or validity of the contract.
